In these terms and conditions, CABLE TV service
means one or more services Subscriber has selected and subscribed
to in the application form. Subscriber must be at least 18
years old.

The CABLE TV service provided to residential
premises is intended for private household viewing only. The
service must not be used for any commercial or illegal purpose.

3. |
(a) |
CABLE TV will install a converter
(whether rented or purchased) with smart card built-in (for
digital converter only; analogue converter has no smart
card built-in) for each Subscriber. If Subscriber chooses
to rent the converter, the rented converter and smart card
remain the property of CABLE TV and must be returned if
the subscription is terminated.

(b) |
Purchase of a converter does
not include any built-in smart card. The smart card (whether
rented or purchased converter) remains the property of CABLE
TV. If the subscription is terminated, Subscriber must return
the smart card within 14 days to CABLE TV.

(c) |
CABLE TV will impose additional
charges (in accordance with the published fee schedule)
if the rented converter and/or smart card are not returned
within 14 days of termination of the service or if they
are returned damaged.
|
(d) |
If a smart card or a converter
(whether rented or purchased) is stolen or lost, Subscriber
must inform CABLE TV immediately. A converter and smart
card once reported stolen or lost may not be used again.
|
(e) |
CABLE TV retains the intellectual
property in the converter (whether rented or purchased)
and the right to modify the converter and the smart card
in it without prior notice.
|
(f) |
The converter (whether rented
or purchased) and smart card must not be opened up except
by CABLE TV's authorized representative, or be tampered
with in any way. To take the smart card out in order to
return it to CABLE TV is the only circumstance under which
Subscriber may open up the converter. Subscriber is responsible
for any damage to the converter and/or smart card while
they are in Subscriber's control, possession or custody.

(g) |
The converter (whether rented
or purchased) and smart card must be used only at the registered
service address where they are installed by CABLE TV. The
converter must not be connected to more than one television
receiver or to any other equipment. A relocation fee will
be separately charged for any use of the converter and smart
card in or for any place other than the original registered
service address.

(h) |
CABLE TV will refund the deposit,
less any outstanding subscription, converter rental or program
fees, if the converter and smart card are returned undamaged
and in full working order. Any refund will be made in accordance
with CABLE TV's Code of Practice for Customer Services.

(i) |
Subscriber who has purchased
a converter enjoys free maintenance service for the 1st
year for normal usage. Subscriber may extend the maintenance
period from the 13th month onwards by paying an annual maintenance
fee.

Subscription for CABLE TV service must be at
least for the period set forth in the application form ("Commitment
Period"). Upon the expiry of the Commitment Period, subscription
will be automatically renewed from month to month at the then
prevailing rate(s) for the subscribed CABLE TV service. Subscriber
may cancel or change his subscription to all or part of the
subscribed CABLE TV service by giving not less than 30 days
written notice to CABLE TV, and the service will be terminated
from the next billing cycle after the expiry of the 30-day
notice or Commitment Period, whichever is the later. Any notice
of termination, to be effective, must be given in the prescribed
form and must be served within the last two months of the
Commitment Period. If the subscription is terminated before
the expiry of the Commitment Period, Subscriber must pay the
subscription fee, converter rental and other fees payable
hereunder for the remaining Commitment Period.

CABLE TV will send to Subscriber regularly
an electronic statement showing the payments due. A hard copy
of this statement will be available upon request and payment
of administrative charge (in accordance with the published
fee schedule). Any dispute over the statement must be raised
within 21 days from the date of the statement; otherwise,
the details and amount of fees contained therein shall be
final and conclusive.
- The subscription fee and the converter rental must be paid
monthly in advance.
- If Subscriber change the registered address for CABLE TV service
(a) |
within 60 days from the
successful installation of the last service, a transfer
fee of $600 will be debited from your account;
|
(b) |
after 60 days from the successful
installation of the last service, a transfer fee of
$300 will be debited from your account;
|
(c) |
to a place where only CABLE
Express Service (MMDS / Satellite Transmission) is available
during the Commitment Period, Subscriber may substitute
the subscribed CABLE TV service with CABLE Express Service
(MMDS / Satellite Transmission) by paying the prevailing
service fee (installation fee to be separately quoted).
(The channels and service available to CABLE Express
Service (Satellite Transmission) subscribers are different
from those available to normal residential subscribers,
e.g. pay-per-view programs, certain Premium Services
and other service packs are not available). If Subscriber
does not wish to make the replacement and requests to
terminate CABLE TV service, Subscriber must settle immediately
all fees payable hereunder for the remaining Commitment
Period. If the remaining Commitment Period is 12 months
or more, Subscriber may subscribe to CABLE Express Service
(MMDS / Satellite Transmission) for the remaining months.
If the Commitment Period is less than 12 months, Subscriber
has to have a 12-month contract for CABLE Express Service
(MMDS / Satellite Transmission);

(d) |
to a non CABLE TV ready
address within the Commitment Period, Subscriber must
give CABLE TV not less than 30 days' prior notice in
writing. Upon the expiry of the 30-day notice period,
CABLE TV shall freeze and suspend Subscriber's account
and the provision of the CABLE TV service for the remaining
Commitment Period until such time when network connection
is available at the new place. If, however, the required
network connection is still not available at the expiration
of the Commitment Period, any subscription fee paid
or payable for the part of the Commitment Period during
which CABLE TV service has been suspended or frozen
will be deemed to have been spent and absolutely forfeited
and CABLE TV may at its sole and absolute discretion
terminate Subscriber's subscription. For the avoidance
doubt, the suspension or freezing of account by CABLE
TV pursuant to this clause shall not release any of
Subscriber's payment obligations hereunder.

- *Premium Services:
(a) |
Subscription to the Premium
Services cannot be changed or cancelled during the Commitment
Period, Subscriber may however subscribe to additional
premium services (i.e. premium channels and pay-per-view
programs as applicable).
|
(b) |
Payment for premium channels
is for a minimum of one month and must be paid in advance.
|
(c) |
Payment for pay-per-view
movies and other pay-per-view programs must be made
by the payment due date shown on the monthly statement.
|
(d) |
Any order for pay-per-view
services (however made through Subscriber's account)
is deemed a valid order. CABLE TV is not under a duty
to verify the identity of the person or whether he is
under the age of 18, or be responsible if anyone is
offended by a program.
|
(e) |
IPPV credit value deposited
in the smart card is non refundable & non-transferable.
|

*If Subscriber has registered for any channel
containing adult material, Subscriber must ensure that the
adult material is not viewed by any person under the age of
18 or by anyone who may be offended by it.
- The installation fee and subscription fee are not refundable
or transferable.
-
CABLE TV may impose a charge on Subscriber
for technical services provided beyond normal CABLE TV maintenance.
- A late or invalid payment may be subject to a surcharge in
accordance with the published fee schedule.
-
CABLE TV will impose a handling charge if a
collection agency is used to recover the rented converter
or any outstanding fees.
-
If Subscriber selects to pay the rented converter
deposit, converter rental or monthly fees by credit card then
CABLE TV may, at any time, debit all fees due, including the
deposit or any outstanding fees or any additional charges
in respect of ALL service account(s) maintained with CABLE
TV under Subscriber's name to the credit card account, or
its replacement card as provided by Subscriber or the card
issuer (as the case may be) from time to time.
- CABLE TV may vary the rates charged to Subscriber by giving
not less than one month's notice.

CABLE TV may at any time change the contents
or nature of any channel and the number of channels available
(the channel line-up), and withdraw any channel(s) with or
without replacement.

Subscriber acknowledges and agrees that connection
to CABLE TV's service(s) may cause the loss of or affect the
reception of other telecommunications and/or broadcasting
signals and services, including but without limitation SMATV
or Closed Circuit TV signal.

Subscriber hereby authorizes any personal data
information he provides to CABLE TV to be used by CABLE TV
or any selected third parties for the following purposes:
disclosure where required by any applicable law; to inform
Subscriber of any products, services or offers of CABLE TV
or other companies (if Subscriber does not want to receive
this type of information, please write to our Personal Data
Officer quoting Subscriber's account number) and to serve
Subscriber and his/her service accounts (for Cable TV service
or otherwise) with CABLE TV, including credit reference checks,
debt collection and market research. Subscriber may at any
time to request access to information held by CABLE TV about
Subscriber or his/her account and to correct such information.
CABLE TV may impose a modest charge to cover the costs of
complying with such request, which should be made in writing
to the Personal Data Officer, 11th floor, Cable TV Tower,
9 Hoi Shing Road, Tsuen Wan, New Territories, Hong Kong.

CABLE TV may suspend or terminate the service
if Subscriber breaches any of these terms and conditions including
non-payment of any fees due. In the case of such termination
all prepayments will be forfeited.

Neither Subscriber nor CABLE TV is liable for
non-performance of its obligations if the non-performance
is due to circumstances beyond its reasonable control (a force
majeure event).
-
CABLE TV may change these terms and conditions
at any time. Subscriber is deemed to have accepted these terms
& conditions (as amended from time to time) by continuing
the subscription.
Additional Terms for CABLE Express Service (MMDS / Satellite
Transmission)
In addition to the Terms & Conditions for CABLE TV service, the
following terms shall also apply to CABLE Express Service (MMDS
/ Satellite Transmission).

The Channels and services available to CABLE
Express Service (Satellite Transmission) subscribers are different
from those available to normal CABLE TV service subscribers
(e.g. pay-per-view programs, certain Premium Services and
other service packs are not available).

Should installation arrangements or reception
of signal by the dish antenna be affected to an unacceptable
extent by factors beyond CABLE TV's reasonable control, CABLE
TV may terminate its service without being in any way liable
to Subscriber.
-
CABLE TV will install a MMDS / Satellite receiver,
all necessary wiring and wall plates at the service premises
after payment of the Installation Fee. Subscriber must share
a dish antenna with another subscriber if circumstances require,
as judged by CABLE TV. All equipment and wiring installed
by CABLE TV remain the property of CABLE TV. CABLE TV will
impose additional charges for any equipment loss (dish antenna,
LNB or etc.) where they are in Subscriber's control, possession
or custody.

Subscription for the CABLE Express Service
(MMDS / Satellite Transmission) of CABLE TV service is for
a minimum of twelve months ("Commitment Period") for the first
converter. Subject as aforementioned, clause 4 of these terms
and conditions shall apply to CABLE Express Service (MMDS
/ Satellite Transmission).

The provision of CABLE Express Service (MMDS
/ Satellite Transmission) is subject to The Government of
the Hong Kong Special Administrative Region ("Hong Kong")
not taking back from CABLE TV's operations the frequencies
for MMDS / Satellite transmission. Should The Government of
the Hong Kong withdraw the frequencies, the service shall
terminate on the date of withdrawal of frequencies and no
party shall have any claim against the other as a result of
the termination.

Reception of CABLE Express Service (MMDS /
Satellite Transmission) signal may be affected by unstable
weather conditions.
-
Subscriber must receive CABLE TV service only
through a converter supplied by CABLE TV in Hong Kong, and
must not retransmit such service.

From the date hereof up to and including the
date of termination of this subscription, Subscriber shall
take all necessary measures steps and precautions to protect
the dish antenna from and against all loss, destruction and
damage caused by bad weather and other natural calamities
including rainstorm, thunderstorm, typhoon and earthquake.
Subscriber shall be wholly responsible for any loss damage
or injury caused to any person whomsoever or any property
whatsoever whether directly or indirectly through the defective
or damaged condition of the dish antenna as a result of the
negligence or the act omission or default of Subscriber in
complying with the aforesaid obligation. TO THE EXTENT PERMITTED
BY LAW, IN NO EVENT SHALL CABLE TV BE LIABLE FOR ANY OF SUCH
LOSSES OR DAMAGES INCURRED BY EITHER SUBSCRIBER OR ANY THIRD
PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT (INCLUDING
NEGLIGENCE).
Additional Terms for Coupon Package (Not applicable to
CABLE Express Service - Satellite Transmission)
In addition to the General Terms and Conditions for CABLE TV service,
the following terms shall also apply to the Coupon Package (for
viewing pay-per-view programs).

Subscriber of any CAT Coupon Package must be
eligible to register with CABLE TV for viewing of channels
containing adult material, must first have registered for
such channels, and must ensure that any adult material is
not viewed by anyone under the age of 18 or by anyone who
may be offended by it.
-
Only a residential Subscriber may purchase
a Coupon Package. Subscriber using a digital converter may
purchase Coupon Package with "Points" as unit (the "Points"
will be deposited in the smart card installed in the digital
converter), or the Coupon Package with "Coupons" as unit.
-
Coupon Package with "Coupons" as unit may be
used for booking of programs through telephone. Whereas Coupon
Package with "Points" as unit may only be used for booking
of programs through remote control (of the digital converter).
-
All credit value deposited under a Coupon Package
in a smart card or in a Coupon, expires after 12 months from
the date of purchase or date of "add value" (whichever is
applicable). Coupons will be deducted in the order of date
of purchase i.e. first purchased first deducted.
-
Before expiry, the Coupon Package may be used
for all pay-per-view programs except special events (such
as boxing), and programs with promotional price or other CABLE
TV services.
-
CABLE TV has the right to decide whether to
allow any particular pay-per-view special event, and programs
with promotional price or other CABLE TV services, to be purchased
under a Coupon Package.
-
CABLE TV has the right at any time, to offer
new Coupon Packages.
-
Subscriber may purchase Coupon Package with
"Points" as unit only once a day ("a day" being the 24 hour
period from 12:00 midnight to 11:59 pm of the same day).
-
If Subscriber has any outstanding balance due
to CABLE TV, CABLE TV has the right to refuse to let him purchase
a Coupon Package, or use any Coupon Package already purchased
to make bookings of programs.
-
CABLE TV will bill Subscriber for any outstanding
balance due to CABLE TV in respect of any booking made with
insufficient "Coupons".
-
If Subscriber moves to a non-serviceable address
or non-PayPerViewService-ready address, any unused Points
in the smart card, or any unused Coupons, will be forfeited.
-
All Points and Coupons purchased are non-refundable
and non-transferable, and cannot be used for settlement of
any outstanding balance.
-
No Coupon Package may be transferred to an
account of a third party. Coupon Package with "Points" as
unit purchased using one converter may not be transferred
to a different converter, even if the other converter is under
the same Subscriber's account.
-
No booking of programs made under a Coupon
Package may be cancelled.
* Applicable only to those subscribers who receive premium channels
services and the pay-per-view service.
