Thank you for using i-CABLE . We always dedicate ourselves to provide you with quality services. Please be advised that the General Terms and Conditions and Service Plan Terms and Conditions of i-CABLE Broadband Services will be amended effective from 25th Aug, 2008. For details, please refer to the amended "General Terms and Conditions of i-CABLE" and "Service Plan Terms and Conditions of i-CABLE" below.

  1. In these terms and conditions
 
'we', 'us', 'our', 'ourselves','i-CABLE' refers to Hong Kong Cable Television Limited trading as i-CABLE, including its assigns, transferees and successors
  1. You agree to rent a Cable Modem Set for so long as you subscribe to our Services. For the avoidance of doubt, upon the expiry of the Commitment Period (as defined in Clause 68), your rental of Cable Modem Set will be automatically renewed and continued from month to month until the termination of your subscription of our Services. Should you wish to terminate your rental or change your service or payment plan, you must give us not less than 30 days' prior notice in writing and the subscription will be terminated effective upon the expiry of the 30-day notice period or the Commitment Period, whichever is the later. Any notice of termination, to be effective, must be given in the prescribed form and shall not be served earlier than the last two months of the Commitment Period.

  1. Within 30 days upon termination of your subscription (for whatever reason), you must return the Cable Modem Set to one of the designated Cable Modem collection centres in the same condition as they were supplied to you (fair wear and tear excepted), failing which you shall be liable to us for compensation or damages.

  68. (a)

This is a fixed-term agreement and you are not allowed to early terminate it or change your service plan before the end of the Commitment Period. If you elect to do so, you must give us not less than 30 days prior notice in writing (in our prescribed form) for early termination. If accepted, the early termination will take effect upon the expiry of the 30 days' notice period; and we shall debit to your account a service termination fee (as liquidated damages) equivalent to the total subscription fees payable for the remaining Commitment Period. We are entitled to retain your advance payment (if any) to settle the said service termination fee.

(b)

Upon expiry of the Commitment Period, your subscription for the Services will be automatically renewed from month to month at the then prevailing rate for the Services unless we receive from you not less than 30 days' written notice (in our prescribed form) for service termination or change of service plan or payment plan. Such notice may not be served upon us earlier than the second last month of the Commitment Period (otherwise, we may treat such notice as a notice given under Clause 68(a)). If accepted, the service termination will take effect upon the expiry of the said 30 days' notice period or the Commitment Period, whichever is the later.

  70. (a) If at any time you want to change the registered address for the Services, you must give us not less than 30 days' prior notice in writing before such change can be effective. A transfer fee of HK$500 shall be charged for each request for change but may be waived by us if:
(i)

at the time the change takes place, you still have a fixed-term subscription contract with us which has more than two months remaining in the Commitment Period; or

(ii)

you enter into another fixed-term contract for the Services with us.

   
    (b) If at any time during the Commitment Period, you want to change the registered address for the Services to a place where the Services (or one or more of the Services in case of subscription contract for bundled Services, that is service package including Services provided by other service operators ("Bundled Services")) are not available, you must give i-CABLE not less than 30 days' prior notice in writing. You may choose either of the following options to deal with the remaining Commitment Period after the expiry of the 30-day notice period:
(i)

We may freeze and suspend your account and the provision of the Services for the remaining Commitment Period until such time when network connection is available at the new place (in case your subscription consists only of the affected Service, the Commitment Period will also be suspended when provision of the Service is frozen and suspended; but where your subscription is for Bundled Services, the original Commitment Period end date will remain unchanged notwithstanding the suspension of one or more Services due to the aforesaid reason). Suspension or freezing of your account by i-CABLE pursuant to this clause shall not however release any of your payment obligations hereunder and you shall continue to pay all the fees due hereunder. If, however, the required network connection is still not available at the expiration of the Commitment Period, any subscription fee paid or payable for the part of the Commitment Period during which Services have been suspended or frozen will be deemed to have been spent and absolutely forfeited and i-CABLE may at its sole and absolute discretion terminate your subscription.

(ii) You may elect to terminate the subscription contract and we shall debit to your account a termination fee of $500. Clause 68(a) shall not apply
(iii)

You may enter into a new fixed-term subscription contract with us for the remaining Services that are available at the new place to commence on the expiry of the said 30-day notice period whereupon the current subscription contract shall terminate. This option shall only be available for subscription contract for Bundled Services.

   

Additional Terms and Conditions Applicable to CABLE TV Service

(b)

Purchase of a converter does not include any built-in smart card. The smart card (whether rented or purchased converter) remains the property of CABLE TV. If the subscription is terminated, Subscriber must return the smart card within 30 days to CABLE TV.

(c)

CABLE TV will impose additional charges (in accordance with the published fee schedule) if the rented converter and/or smart card are not returned within 30 days of termination of the service or if they are returned damaged.



  • By subscribing to this promotion plan, you have and are deemed to have entered into separate service agreements with each service provider through their agent, CABLE TV ("Agent"), upon the terms stated in this subscription form and the attached (the General Terms and Conditions of i-CABLE shall also be applicable to i-CABLE HomeLine, unless otherwise stated), which together constitute the entire agreement between you and the relevant service provider with respect to the service it provides. For the avoidance of doubt, the service agreement with CABLE TV for the provision of the Broadband and i-cable.com Services is a separate and distinct contract from the agreement with CABLE TV for the provision of the Bonus Pack/Basic Pack/UFO Pack/CEO Pack Service.
  • Upon the expiry of the Commitment Period, your subscription for the Services will be automatically renewed from month to month at the then prevailing bundled rate for the Services unless we receive from the you not less than 30 days' written notice (in our prescribed form) for service termination or change of service plan or payment plan. Such notice may not be served upon us earlier than the second last month of the Commitment Period (otherwise, we may treat such notice as a notice given under Clause 15). If accepted, the service termination will take effect upon the expiry of the said 30 days' notice period or the Commitment Period, whichever is the later.

  • Subscriber who has joined Cable Modem and/or CABLE TV Converter rental program must return the Cable Modem and the Converter (including smart card) to one of the designated collection centers within 30days after termination service, otherwise a sum of $990and $990(including $100 remote control) will be charged respectively for late return.
 
(a)

If you terminate any one of the Services or change the service plan during the Commitment Period, all Services under the promotion plan will be forthwith terminated and the relevant service providers shall charge and debit to your account a service termination fee equal to total original service fees for the unexpired Commitment Period. i-CABLE HomeLine Customer is liable to pay a cancellation fee of $475 or the aggregate service fees for the whole Commitment Period, whichever is higher. Your entitlement to the promotion benefits named herein will be absolutely forfeited. CABLE TV further reserves the right to recover from you all the promotion benefits provided or credited to your account prior to termination. All prepayments are not refundable or transferable. Failure of number porting will not be a valid reason for termination of subscription. CABLE TV does not guarantee successful number porting.

(b)

Where the promotional offer for the Service(s) ("Secondary Service(s)") which you have selected and subscribed herein is offered to you due to and in your capacity as our existing subscriber of another Service(s) ("Primary Service(s)"), if you terminate the Primary Service (whether during or after the Commitment Period applicable thereto and with or without cause), the price discount offered to you for the Secondary Service(s) herein shall forthwith cease and we shall charge for the Secondary Service(s) at its(their) original price with effect from the termination effective date of the Primary Service.
